Two new certification areas proposed October 15, 2005 Regular News The Board of Legal Specialization and Education has approved two new specialization areas and is looking at a third.Meeting in September at the Bar’s General Meeting in Tampa, the BLSE gave its okay to Intellectual Property Law and State and Federal Government and Administrative Practice as new certification areas. The latter was objected to by the Administrative Law Section, which said the title could be misleading.The BLSE plans to submit the two programs to the Program Evaluation Committee and the Bar Board of Governors at the board’s October 20-21 meeting for initial review. The governors could give their final approval at their December meeting and forward the new certification areas to the Supreme Court for final approval.The board also heard a proposal for subrogation law, but took no final action.The State and Federal Government and Administrative Practice certification is being pushed by the Government Lawyer Section, and immediate past Chair Keith Rizzardi said the section had worked with the Administrative Law Section and the Environmental and Land Use Law Section.At the last minute, he noted, a hitch developed with the Administrative Law Section, which did not like the words “administrative law” used in the title of the proposed new certification area.“It’s about the name to the extent that someone holding that certification would have that specialty,” said Deborah Kearney, chair of the Administrative Law Section. The section executive council, she said, thinks “that this certification would mislead the public that this [certified] person had some degree of experience or expertise in administrative law. That is the crux of the objection.“There are those in our section who had read this with a fine-tooth comb and who believe there are a number of ways a person could get certified without a shred of experience with the state or federal administrative procedure acts.”Rizzardi said part of the problem is how administrative law is defined. The Administrative Law Section sees it as F.S. Ch. 120 and its federal equivalent, he said, while the Government Lawyer Section sees a broader application. That includes lawyers who might work in the Sunshine Law or state government ethics, but not specifically Ch. 120, but still see themselves as administrative lawyers, he said.“We believe people who would pursue this certification would want to be defined this way,” Rizzardi said. “They would say, ‘We are administrative lawyers; we are government lawyers; we are both.’ Just because the Administrative Law Section doesn’t want to play doesn’t mean that the rest of us who put this proposal together are wrong.”He also noted that the two sections had worked well together on the proposal, until shortly before the BLSE meeting when the Administrative Law Section Executive Council voted 10-8 to oppose the certification plan.The BLSE eventually voted, with one objection, to approve the Government Lawyer Section proposal, with the name unchanged.On Intellectual Property certification, attorneys Jim Gale and Stephen E. Nagin noted that the Business Law Section and other interested groups were backing the proposal. They said the criteria were carefully drawn not only to define intellectual property, but also to allow people with related experience to qualify for the new certification.“The areas covered by intellectual property certification include the core areas of patents, trademarks, copyrights, and patent litigation, as well as related areas of trade secrets, covenants-not-to-compete, false advertising, unfair competition, and other areas of law that relate to the protection of intangible property rights,” Gale said after the meeting. “The areas of law to be certified are meant to be inclusive, rather than exclusive, in nature.”That means areas such as unfair business practices, secrecy, and antitrust could count in some cases, he said.“This area is ripe for certification due to the number of lawyers that have begun practicing in this burgeoning area of law and who are now holding themselves out to the public as practicing in the area of ‘Intellectual Property Law,’ he added. “having a certification. . . it will hopefully guide the public to those attorneys who have demonstrated proficiency in this specialized area of the law. Additionally, this area of law is constantly changing and requiring additional education and training. requiring this additional education and training in order to maintain this certification, the public is assured of receiving high quality services from lawyers who are knowledgeable in these latest changes.”Dawna Bicknell, director of the Bar’s certification programs, said if approved by the Board of Governors by December, both certification areas would be submitted to the Supreme Court as part of the Bar’s annual rules package early next year. If the court approves that later in the year, the first certification testing in the new areas could occur as early as 2007.Attorney Sarah Clark Holloway addressed the BLSE about subrogation certification. She said it’s important to recognize the value of subrogation and the key role it plays with the insurance industry.“Insurance companies can spot trends in the claims that they pay. A good example of that is the Firestone tire litigation.. . . It is my understanding that Firestone tires were recalled based on a subrogation case,” Holloway said after the meeting. “If private individuals were trying to sustain this litigation against a giant multi-national corporation, they would have little chance of success, and this litigation benefits the consumer and the public as a whole.”Holloway said several areas of law could be impacted, noting she practices in auto and product liability subrogation, while others may practice in such areas of health benefits subrogation.“They [the BLSE] advised us they were going to consider our presentation and would be in touch with us regarding how they wanted us to proceed in the next step toward the certification process,” she said. Last year, it returned 6.2% on investments and granted its participants and pensioners a 0.18% rise through indexation.It reported asset management and transaction costs of 0.32% and 0.02% respectively and attributed the rise of administration costs from €436 to €521 per participant largely to the transition of its pensions administration to Dion Pension Services last year.The pension fund still carries out risk management, communication and asset management strategy in-house. The €640m Dutch pension fund of British American Tobacco (BAT) has reduced its trustee board by 25%, in part to unburden the employer as the main supplier of board members.On its website, the scheme said it had decreased the board’s size from eight trustees – with four representing the employer and two representing workers – to six.In the new setup, both the number of trustees representing the sponsor and the number of worker representatives have been halved.The scheme said it had added two independent trustees in order to increase the expertise on the board.
